The 3% Withholding On Government Contracts

We need your help to stop a costly and burdensome
tax requirement on architects from taking effect.
Last year, Congress passed a measure tucked into a larger bill in the middle
of the night that would require federal, state and many local governments to
withhold three percent of payments from all government contractors. This means
that architects who design public buildings, from courthouses to schools, would
have their payments reduced by three percent regardless of the size of your firm
or the size of the project.
This provision, which is slated to take effect in 2011, will:
- Place huge financial burdens on design firms
with small profit margins and low cash flow.
- Be incredibly difficult for bookkeepers to track,
especially for subcontractors and those who hire subcontractors.
- Create major administrative headaches on state and local governments.
- Hurt the ability of government agencies to attract and hire
the best design talent.
Worst of all, although the measure is designed to raise money to
pay for other tax cuts, most of the supposed savings come from
an accounting trick.
The good news is that members of the House (Rep. Wally Herger of
California and Rep. Kendrick Meek of Florida) and Senate (Sen.
Larry Craig of Idaho) have introduced legislation to repeal this
measure once and for all. By contacting your members of Congress,
you can alert them to this unfair provision and urge them to
cosponsor the bills to repeal it.
